Terms of Service
This Acceptable Use Policy
(the “Policy”) defines the actions which are prohibited by
FiberNet, LLC of West Virginia (“FiberNet”) to users of the
FiberNet Internet Network. FiberNet reserves the right to modify the Policy
at any time, effective upon posting of the modified Policy to the FiberNet
website. It is the responsibility of the user to review and comply with
the terms of this policy. By continuing use of the FiberNet network you
agree to be bound by this Policy.
Unacceptable Use
1. Transmission, distribution
or storage of material in violation of any applicable law or regulation
is prohibited. This includes, without limitation, material protected
by any copyright, trademark, trade secret or other intellectual property
right used without proper authorization, and any material that is obscene,
defamatory, constitutes an illegal threat, or violates export control
laws.
2. Sending unsolicited mail messages, including the sending of "junk
mail" or other advertising material to individuals who did not
specifically request such material ("e-mail spam"). This includes,
but is not limited to, bulk-mailing of commercial advertising, informational
announcements, and political tracts. It also includes posting the same
or similar message to one or more newsgroups (excessive cross-posting
or multiple-posting). FiberNet accounts or services may not be used
to collect replies to messages sent from another Internet Service Provider
where those messages violate this Policy or that of the other provider.
3. Gaining or attempting to gain unauthorized access to or use data,
systems or networks, including any attempt to probe, scan or test the
vulnerability of a system or network without express authorization of
the owner of the system or network.
4. Unauthorized access, alteration, destruction, or any attempt thereof,
of any information of any FiberNet customers or end-users by any means
or device.
5. Obtaining or attempting to obtain service by any means or device
with intent to avoid payment.
6. Monitoring data or traffic on any network or system without express
authorization of the owner of the system or network.
7. Interfering with any user, host, network or service including, without
limitation, mailbombing, flooding, deliberate attempts to overload a
system or network and broadcast attacks or any activities that will
cause a denial-of-service to any FiberNet customer or end-user by any
means or device.
8. Forging of any TCP/IP packet header or any part of the header information
in an email or newsgroup posting.
9. Sending unsolicited mail messages, including, without limitation,
commercial advertisements and informational announcements or attempting
to relay mail through another site’s mail servers without the
express permission of the site’s owner.
10. Using the FiberNet Network to disrupt or interfere with the use
of the FiberNet network by other customer or authorized users.
Each FiberNet customer is responsible
for the activities of its customer base, representatives or end users,
and by accepting service from FiberNet, is agreeing to ensure that its
customer base, representatives or end users abide by this Policy.
